Mary Raftery - "They were calling me a Nazi, citing blood libel"

The late Mary Raftery has been in the news against recently so I am republishing my correspondence with former Irish Times editor Geraldine Kennedy in 2005. 

According to an RTE report on 29 April 2019 Dublin City University "launched an exhibition on the award-winning journalism of the late Mary Raftery. The event coincides with the 20th anniversary of the airing by RTÉ television of her three-part documentary series, States of Fear. The broadcasts prompted the then taoiseach, Bertie Ahern, to issue an unprecedented apology to survivors of institutional child abuse, primarily in Catholic-run industrial schools."

RTE goes on to confirm that the university has also unveiled a new journalism industry award, The Mary Raftery Prize, which will be awarded annually to an individual or small team responsible for journalistic work produced on the island of Ireland which, in the view of the judges, combines the rigorous analysis and commitment to social justice which characterised Mary Raftery's journalism and resulted in a significant impact on society.

This "rigorous analysis" and "commitment to social justice" included a blood libel against the Christian Brothers while her States of Fear series on RTE was a major factor in the false rape convictions of former Sister of Mercy Nora Wall and of a homeless schizophrenic man Pablo McCabe. Ms Raftery had very little to say about Nora Wall following the overturn of the convictions and nothing about Pablo.[Note 1] He was accused in order to make a rape allegation against a nun look more plausible and his abuse by the two accusers and the State, was of no interest to Ms Raftery. (He was the wrong type of victim!). [Note 2]

Once Again - Mary Raftery and Blood Libel

Actually I am the only person who ever used the term "blood libel" in relation to Mary Raftery and I also commented - with reference to her - that the Nazi pornographer Julius Streicher also used to accuse Jews of murdering Christian children. I have certainly not remained silent since the Ryan Report.[published May 2009] However Mary Raftery is a sacred cow among Irish journalists and feels -with some justification - that they will allow her to get away with any lie!

They still are!

Dear Ms. Kennedy,

I am enclosing some articles which I have written concerning Mary Raftery and her accusations of child killing and child abuse directed against the Catholic Church.

In summary:

The Death of Patsy Flanagan

Mary Raftery has accused the Christian Brothers of being responsible for the death of the boy Patsy Flanagan who died following a fall from a staircase in Artane in February 1951. When her "witness" produced three contradictory accounts of the incident (one of which got the date wrong by 5 years), Ms. Raftery tried to square the circle by claiming that a few boys had died in this manner! She produced not a scrap of evidence to support this allegation.

There was an inquest which found the death of Patsy Flanagan to be an accident. Mary Raftery does not mention this in her book. Did she not know about it or did she deliberately conceal this evidence?

Sister Stanislaus and Sister Conception

Mary Raftery has, on several occasions, accused Sister Stanislaus Kennedy of failing to act when she was informed of child abuse in the 1970s in St. Joseph's orphanage, Kilkenny. The social worker who is supposed to have informed her, wrote to the Irish Times to say that he himself was unaware in 1977 that sex abuse was involved and that he only became aware of this in 1995 i.e. nearly 20 years after he is supposed to have informed Sister Stan (Letters page 22 December 1999). This precisely matches what Sister Stan said when Mary Raftery first made her allegation (in the States of Fear series and the book Suffer the Little Children). Yet Ms. Raftery repeats the accusation in her article on 3 March last. She makes a similar accusation against Sister Conception and the late Bishop Birch, in spite of the fact that on 1st March the President of the High Court Mr. Justice Finnegan, specifically exonerated them in his judgment in the case of R. Noctor-v.-Ireland, The Attorney General and Others. (Mary Raftery does not dispute his judgment concerning this issue; she ignores it).

Mary Raftery claimed that Sister Stanislaus had denounced a civil servant on the Kennedy Committee for failing to give credit to the Church for its social work. The three civil servants at the relevant meeting told journalist Breda O'Brien that no such episode had occurred. (One also wrote to the Irish Times to confirm this). This is by no means the most serious allegation made by Mary Raftery. It is important because it can be easily shown to be a lie. And the lie is obviously linked to other tales told by Ms Raftery about Sister Stan and about the Catholic Church.

Brother Joseph O'Connor

A far uglier lie is Mary Raftery's attack on the late Brother Joseph O'Connor who was the Christian Brother responsible for the Artane Boys Band. She claims he was a vicious child abuser. She alleges that a man abused by him was so distraught that he hung around the Mater Hospital for days when Brother O'Connor was dying. He then went into the hospital and lifted the sheet from his body to confirm that Brother O'Connor was dead. BROTHER JOSEPH O'CONNOR DID NOT DIE IN THE MATER HOSPITAL. (The same question arises as with the inquest on Patsy Flanagan - did Mary Raftery not bother to check this extraordinary story or did she conceal evidence?)

I assume that Mary Raftery tells lies about Brother O'Connor for the same reason she tells lies about Sister Stanislaus i.e. they are both well known Catholics and demonising them is a way of getting at the Church.

Nora Wall

Mary Raftery's treatment of the Nora Wall scandal in her book is grossly misleading. She fails to state that Nora Wall's two accusers had made a string of rape allegations against various people. Above all she fails to mention the main reason for the collapse of the trial i.e. a man read an article about the case in The Star newspaper and recognised one of the women as the person who had made a false allegation against himself!

I was told by one of Nora Wall's defense team (Sean Costello of Frank Ward and Co. Solicitors) that she had been convicted because of a climate of hysteria created by the media and SPECIFICALLY BY THE STATES OF FEAR SERIES!

Anti-Semitism and Anti-Clericalism

In his book "The Rise and Fall of the Third Reich", William Shirer has this to say about Hitler's favourite anti-Semite Julius Streicher:

"A famous fornicator he made his fame and fortune as a blindly fanatical anti-Semite. His notorious weekly Der Stuermer thrived on lurid tales of Jewish sexual crimes and Jewish "ritual murders"; its obscenity was nauseating even to many Nazis".

Ms. Kennedy, if even some Nazis were nauseated by Julius Streicher, what is Mary Raftery doing writing for the Irish Times? Do you believe that anti-clerical hatred is morally superior to the Nazi variety? You will note that they both involve lying allegations of sexual crimes and of child killing.

I intend to distribute this material as widely as possible. If yourself or Mary Raftery feel that any of it is mistaken, please let me know within the next week and I will take your views on board. In the meantime I will send this to the National Union of Journalists only.

Dear Ms Kennedy 

Thanks for your reply dated 21 April which I received on the 26 th. 

I actually sent all of the material to Mary Raftery by registered post on 18 April. I also copied it to the National Union of Journalists as I believe that Ms. Raftery must have breached every article of their Code of Conduct. I have not yet received a reply from her and I am now distributing this material as widely as possible. I understand that the NUJ will only accept a complaint if it comes from another journalist so I am concentrating on journalists. 

Yes I believe that Mary Raftery is not just mistaken but is telling deliberate lies. A blatant example is when her "witness" to the death of Patsy Flanagan tells three contradictory stories (one of which gets the date wrong by 5 years). Instead of withdrawing her allegations Mary Raftery tries to square the circle by claiming that more than one boy died in this way in Artane (i.e. by falling from a staircase)! 

Mary McCarthy once said about the Stalinist Lillian Hellman : "Every word she writes is a lie, including 'and' and 'the'." That neatly sums up my attitude to Mary Raftery.

The Apologies of the Sisters of Mercy - and the Visit of Pope Francis to Ireland

I have an article on my old website IrishSalem.com concerning the Irish Sisters of Mercy - and their policy of abasing themselves before people who make false allegations of child abuse. It begins as follows:

Together with the Christian Brothers, the Sisters of Mercy have been THE major target for false accusations since at least 1996. The Sisters policy of apologising to false accusers has had disastrous consequences - and not only for themselves. They appear to believe that a false accuser is a "deeply hurt" person and that an apology will lead to "healing and reconciliation". The outcome of this policy is that no distinction is made between vicious fraudsters and people who may have a genuine grievance. Not surprisingly, their apologies have been met with loathing and ridicule but other religious orders have followed suit and eventually the Bishops themselves, (even though the latter had initially defended themselves strongly to the extent of suing media that slandered them).

I recently posted two comments on an article in America Magazine entitled U.S. Sisters Demand Action on Sexual Abuse Crisis by Michael J. O'Loughlin. The "action" the American Sisters are demanding is that they be protected from sexual abuse and harassment "perpetrated by those in positions of trust in the church community". [my emphasis]. This demand does not seem to refer to harassment from persons making false allegations of child abuse, child rape and child murder. Do American nuns really not face this problem - which is a major issue in Ireland? Or can it be that the group referred to in the article the "Leadership Conference of Women Religious" [LCMR] have no interest in defending their falsely accused colleagues? The latter is certainly the case in Ireland. The Irish counterpart of the the American group is the Association of Leaders of Missionaries and Religious of Ireland [AMRI] . This Association is led by the Sisters of Mercy who have gone out of their way in attempting to appease people who despise them!

First Comment re Article "US Sisters Demand Action on Sexual Abuse Crisis"

I sent a message to the American Religious Sisters of Mercy concerning their counterparts in Ireland; the latter took the side of people who made false allegations of child rape and murder against their own colleagues - and failed to withdraw their support from false accusers even when the Court of Criminal Appeal issued a Certificate of Miscarriage of Justice to one former nun! I wrote:

Regarding the visit of Pope Francis to Ireland, can the Irish Sisters take this opportunity to withdraw their apology to the accusers of Nora Wall (formerly Sister Dominic). See Wikipedia article on Nora Wall. Also reprimand our current Minister for Justice Charlie Flanagan for repeating in 2009 a libel for which Nora Wall had received damages from the Sunday World in 2002. He did so under Parliamentary Privilege and the Irish Sisters said nothing at the time.

Finally the Irish Sisters should withdraw their apology to the Howe family who accused Sister Xavieria Lally of murdering baby Marion Howe with a red hot poker in 1955. The Howe's made that claim in an article in the Daily Mirror on 11 October 1997. Try googling the headline
"HOT POKER WAS USED ON LITTLE MARION.. NO CASH WILL GET HER BACK; I THINK MY BABY WAS MURDERED AT THE ORPHANAGE, SAYS PAYOUT MUM".

Daily Mirror executives rightly believed that the Sisters of Mercy would not object and would prevent Sister Xavieria from defending herself or suing for libel. An article in the far more "respectable" Irish Times on the same date observed: "Why then has the order issued qualified apologies? Why has it paid compensation to the Howes, albeit a relatively meagre sum? Is there not a tacit admission here that what these people say happened did happen? Or are we to believe that the Sisters of Mercy have taken to paying compensation and issuing apologies for things that didn't happen at all?"

In contrast Nora Wall, no longer a Sister of Mercy, successfully sued the Sunday World for libel in 2002, received a Certificate of Miscarriage of Justice from the Court of Criminal Appeal in 2005 and successfully sued the Irish Government and Director of Public Prosecutions in 2016 (after a battle lasting a decade which her former colleagues ignored). Sister Xavieria is now deceased but is owed an apology by her colleagues who betrayed her and allowed her to be vilified precisely because she did NOT leave the Congregation. The visit of Pope Francis, the Pope of compassion should motivate those colleagues to repent and - at the very least - withdraw their apologies to those who slandered Nora Wall and Sister Xavieria.

No reply from either the Irish Sisters of Mercy - or their American counterparts. I presume the latter are part of the group who are now criticising the Bishops for failing to protect nuns!!

WHO exactly do you mean? My information about the Religious Sisters of Mercy in Ireland is that there was a conflict between Liberals and Conservatives in the Congregation about how to deal with a avalanche of allegations, some of which were impossible to disprove 40 or 50 years later but others were either proven to be false (rape allegations against Nora Wall and Pablo McCabe) or OBVIOUSLY ludicrous from the beginning (murder allegation against the late Sister Xavieria Lally).

The Conservatives wanted the Congregation leaders to defend the innocent and to condemn false accusers. The "Liberals" - who predominated in the leadership - took the view that even women who told obvious lies about the nuns must have been deeply hurt by the Church in order to say such things; therefore the proper response to their pain was to apologise to them and to pay "compensation", for which no proof of wrongdoing would be required. By a truly incredible co-incidence, the younger liberal leaders who took this decision were not themselves the target of the obscene allegations - it was the older nuns who objected to this approach and it was THEY who were thrown to the wolves!

The above article by Michael J. McLoughlin is entitled "U.S. Sisters Demand Action on Sexual Abuse Crisis". Would I be correct in assuming that the Leadership Conference of Women Religious whom he quotes, have never condemned false allegations against clergy or nuns? Also that the Religious Sisters of Mercy in the USA are members of this Leadership Conference??

Apart from the Wikipedia article on Nora Wall, there is an article by Breda O'Brien in the Irish Jesuit Review 'Studies' entitled "Miscarriage of Justice: Paul McCabe and Nora Wall"

It focuses on the homeless schizophrenic man whom the Irish Sisters of Mercy ALSO betrayed. (See NOTES [1] and [2])

"Out of the mouth of babes and sucklings hast thou ordained strength"

The above quote comes from the King James Bible translation of Psalm 8:2. In this particular case, strength and wisdom come from the internet magazine SpikedOnLine which is edited by atheist Irishman Brendan O'Neill. A recent article "Can Poetry Survive Outrage Culture" was penned by writer Candice Holdsworth. It concerns the sad fate of a poet Anders Carlson-Wee who was savaged by an online social,media mob for a poem published in the (very liberal) Nation magazine last month. Once the mob denounced the poem as non-PC, the two poetry editors at the Nation who had accepted it, completely backed away from the work and published an apology, which they posted above the poem. They said they had made ‘a serious mistake’, were sorry ‘for the pain we have caused to the many communities affected by this poem’, and planned to ‘earn the trust back’ of their readers. Poet Carlson-Wee also grovelled. 

It's very reminiscent of the behaviour of the Irish Sisters of Mercy abasing themselves before false accusers in the hope of "healing their pain" and "promoting reconciliation"! Two readers who commented on Holdsworth's article explained the mentality very well.

The poet's self-abasement had the usual effect - the mob smelled blood and doubled-down on the claimed outrage. His cringing and cowering statement was itself deemed 'problematic' and full of 'thought-crime'.

Never apologise to these buggers, it won't get them off your back. You can never be apologetic enough and they don't ever accept it as contrition, just as an admission of guilt for which there is no redemption.

Besides, does anyone actually believe the apologies? They only thing the apologizing party achieves is severely diminishing the amount of respect anyone has for them, and probably their own self-respect.

NOTES regarding Pablo McCabe

[1] Paul (Pablo) McCabe was Nora Wall's co-accused and the "homeless schizophrenic man whom the Irish Sisters of Mercy ALSO betrayed". He was the ultimate victim of this miscarriage of justice. Obviously he had no money but prior to 1999, no woman had ever been convicted of rape in Ireland so Regina Walsh fingered him as the main rapist and claimed that Nora Wall had held her down while Pablo had raped her. Her intention was to claim "compensation" from the Sisters of Mercy; Pablo was "collateral damage"!

Breda O'Brien's article in Studies Review in Winter 2006 focuses on Paul McCabe and indicates how the very Merciful Sisters originally favoured him:

Paul McCabe addressed a Diocesan Gathering of Mercy Sisters in Gracedieu in Waterford in 1988. His account tells of being born in Dublin in 1949 to a single mother. She struggled on until Paul was three, but she ‘had great difficulty in working, paying for accommodation and paying someone to look after me.” Thus he came to live in what was to become known as the “ old St. Michael’s”, a junior industrial school run by the Sisters of Mercy in Cappoquin. His memories of that time are “very happy ones of caring and interested women.” He then went to the Industrial School at Artane, Dublin, which he found traumatic, as it had “over nine hundred boys in a very strict set-up.”.....

So when Pablo could be presented as a victim of the Patriarchy, the Sisters allowed him to  address one of their annual meetings. It's difficult to imagine John Charles McQuaid, the doyen of the Irish Catholic Church in the  20th century doing anything similar. But McQuaid would never have betrayed an innocent man (and one of his own priests) as the Sisters betrayed Pablo McCabe and Nora Wall!

[2] This is the text of the Sisters of Mercy apology to Regina Walsh - as per the Wikipedia article on the case:
"We are all devastated by the revolting crimes which resulted in these verdicts. Our hearts go out to this young woman who, as a child, was placed in our care. Her courage in coming forward was heroic. We beg anyone who was abused whilst in our care to go to the Gardaí."

The article continues:
Even after the collapse of the case against the two accused, the Sisters of Mercy made no effort to apologise to Wall or to withdraw their statement of support for Walsh. One commentator remarked: "The young woman their hearts were going out to, was the false accuser, not their own innocent nun. Our absolutist system had seduced them into identifying with the accuser and betraying their own sister."


The media which had savaged Nora Wall ("Vile Nun", "Pervert Nun", "I Was Raped by Anti-Christ") put no pressure on the leaders of the Sisters of Mercy to withdraw their apology. As for their own consciences - well perhaps the visit of Pope Francis will cause the Merciful Sisters to reconsider their behaviour??

Blood Libel in Ireland - directed against Catholics not Jews!

(i) In 2006 the Sunday Tribune offered to publish a letter on this subject if I reduced it to an acceptable length. However this version is already a summary of a much longer submission I made to the Irish Human Rights Commission in 2004, requesting them to investigate the allegations of child murder etc made by the media against the Christian Brothers. I felt I could not summarise it any further so the project lapsed.

I refer to the controversy concerning false allegations of child abuse. Some leaders of "victims" groups seem to find it very difficult to accept the idea that such allegations exist. A spokesperson for "One in Four" claimed that out of thousands of claims to the Redress Board, only one was found to be false.

For some years now I have been looking into accusations of child killing which have been made against the Christian Brothers and other religious. I choose this topic because it is something that can be investigated long after the supposed events. In most cases no boy died at the time in question so it is not even a case of "honest" hysteria but blatant lying. (I call these "Murder of the Undead" allegations!) [NOTE: I later coined the additional phrase "Victimless Murders"]

If someone accuses you of child abuse 30, 40 or even 50 years ago there is no way you can clear your name. However if the same person claims you killed a child and no child died at the time, then this says a great deal about your accuser's credibility.

The following is an extract from a letter I wrote to the Irish Human Rights Commission in March 2004 regarding this issue. I list some of the more prominent "Murder of the Undead" allegations.

1. Patsy McGarry's article in the Irish Times on 25 September 1999 quoting Patrick Walsh of SOCA who claimed to have attended the funerals of boys killed by the Brothers. No boy died while Patrick Walsh was in Artane so his claim is not even "honest" hysteria. Mick Waters of SOCA UK wrote to the Irish Times on 17 October 1999 to express his support for Patsy McGarry. This gentleman still retains his position in SOCA UK, as indeed does Patrick Walsh in SOCA. (I have seen the latter quoted as a spokesman for SOCA on several occasions). [NOTE: SOCA = "Survivors of Child Abuse"]

2. Louis Lentin's programme "Our Boys" on TV3 in October 1999 that was repeated in November 2000, quoting Gerry Kelly (then head of the "Alliance for the Healing of Institutional Abuse") who also claimed to have attended funerals of murdered boys. Again no boy died while Gerry Kelly was at Artane.

Gerry Kelly also slandered Nora Wall (see articles in Ireland on Sunday dated 25 July and 1st August 1999). Moreover, a few weeks before they first broadcast Our Boys, TV3 were forced to apologise to the Bishop of Cloyne for libelling him. (This apology was buried by the media - I found out about it myself when I rang the Bishop's office to ask how his legal case was going!).

3. John Kelly of SOCA who told me on the steps of the Pro Cathedral and in front of several journalists, that there were mass graves in Artane and other  institutions (quoted in the Irish Independent on 25 November 2002)

4. Brighid McLaughlin quoting Mannix Flynn in the Sunday Independent on 22 December 2002, that there had been a "holocaust" at Letterfrack with boys buried all over the place and also that the Gardai at Clifden had uncovered a "massive paedophile ring" which ran "from the low minions right up to the top". In January 2003, a few weeks after he made those allegations, Mr. Flynn was elected a member of Aosdana, the association of creative artists and he has recently been made Director of the Irish Museum of Modern Art Is this in spite of, or because of, his vicious lies?

5. Mary Raftery who claimed in the TV programme "States of Fear" and in her book "Suffer the Little Children" that there were "deaths in mysterious and unexplained circumstances" in Artane. She failed to mention that the one case which she quoted had been the subject of a coroner's report and when her "witness" gave three separate and contradictory accounts, she tried to resolve the contradictions by claiming - on Today With Pat Kenny 22/11/99 - that there was more than one such death (i.e. due to a fall from a staircase). See letter from Brother M. Reynolds in the Irish Times on 22 December 1999.

In a letter to the Irish Times on 13 January 2000 Mary Raftery claimed that the death of the boy was the subject of an ongoing Garda investigation. When the Garda Press Office confirmed that this was not the case, Mary Raftery's response (on Eamon Dunphy's The Last Word) was "This is complete rubbish. This is rubbish. This is rubbish" (see Letters page on 26 January 2000). It is clear that she wants the Christian Brothers to have murdered a boy in order to justify her own hatred!

6. Mary Raftery also made thuggish allegations against Sister Stanislaus Kennedy, accusing her of failing to act when a social worker told her a boy was being sexually abused. (She also accused Sister Stanislaus of berating civil servants at a meeting because they failed to give sufficient credit to the Church for its social work). Sister Stan was subjected to sustained and vicious attack in the media until the social worker wrote to the Irish Times to confirm that, at the time he spoke to her, he himself had no idea that sex abuse was involved and that he felt that Sister Stan had done everything possible for the children. Edward Murphy's letter is in the Irish Times Letters Page on 22 December 1999. It did not make the news pages. Of course Mary Raftery made no attempt to apologise. (Nor did she apologise when the three civil servants involved in the meeting told Breda O'Brien that no such episode had taken place).

7. Mary Raftery also claimed that a boy who said he had been sexually abused by Brother Joseph O’Connor, waited around the Mater Hospital when Brother O’Connor was dying and then went in to take a look at the body to make sure he was dead. Brother Joseph O'Connor did not die in the Mater Hospital. Again there was no apology from Ms. Raftery. (Brother Joseph O'Connor was the Brother responsible for the Artane Boys Band. Sister Stanislaus helped to set up the first childcare course for lay people in Ireland. I assume this is why Mary Raftery attacked them.)

8. Liam Reid’s article in the Irish Times on 27 November 2003, which deliberately repeats the blood libel about the death of William Delaney in 1970. Following a disgusting media campaign in 2001 the Evening Herald was forced to admit that the post mortem on the exhumed body of William Delaney had found that he died of natural causes (Evening Herald, 27 April 2001). However, having howled obscenities at the Christian Brothers, the media dropped the issue like a shot. Liam Reid is depending on people having short memories.

In December 2003 the Royal College of Surgeons published a study on clerical sexual abuse. This pointed out that the Irish Times used the term "paedophile priest" 322 times between August 1993 and August 2000. Apart from the term "paedophile farmer" which was used 5 times, no other occupation was linked to paedophilia in reports. (I understand that the references to "paedophile farmer" occurred when a social worker wrote to the Irish Times to enquire why it never used such terms and a farmer then wrote in to protest!). The Irish Times is anti-clerical in the same way other publications are anti-Semitic or racist.

9. Bruce Arnold’s article about Letterfrack in the Irish Independent on 18 June 2003 which claimed that "boys are buried in the woods as well". Garda Superintendent Tony O’Dowd told the Irish Catholic (9 and 16 January 2003) "there was no evidence available that would suggest that foul play led to the deaths of anyone buried inside or outside of the cemetery at the old industrial school of Letterfrack". Mr. Arnold should be asked to produce his evidence.

10. Finally though it did not involve a murder allegation I would request the Commission to question Paul Williams of the Sunday World about his repulsive allegations against Nora Wall on 11 July 1999 i.e. that she had procured children for Fr. Brendan Smyth. Former residents and a "counselor" - all un-named- are quoted in support of the allegations. Who are these people and whom else have they made allegations against?

Nora Wall won damages against the Sunday World. However the story of her "victory" was buried by the media. I myself saw it by accident, in a short article in Phoenix on 8 November 2002, which failed to mention the nature of the libel or the name of the journalist responsible. Paul Williams is now Crime Editor for the Sunday World. I think he was Crime Correspondent in July 1999, which suggests that he has been promoted since the libel!

Reaction of the Irish Human Rights Commission 
They said these allegations were a matter for the Director of Public Prosecutions. I already told them he had refused to prosecute two sets of "Murder of the Undead" allegations - by Patrick Walsh and Gerry Kelly - under the Incitement to Hatred Act. (See nos 1 and 2 above).  However he prosecuted a bus driver for telling a black passenger to "go back where you came from" and the driver was convicted of incitement!

They also said that this issue was not in their 3 year Plan. However one of the Commissioners is taking a case to the Supreme Court to have her lesbian marriage recognised in this country.  She is being supported by the IHRC so presumably THAT is in their Plan!

THE REASON WHY 
And my own motivation? I once had a teacher, a De La Salle Brother called Maurice Kirk who became one of the main influences on my life. He died in a car crash on 10 April 1974 but I remember him still. A bit like "Tom Brown's Schooldays" really!

Subsequent Episode of Blood Libel - Alan Shatter T.D. in 2009

When I wrote to the Sunday Tribune in 2006, I thought that the claims of child murder directed against Catholic Religious were more or less finished. Our anti-clerics had come to recognise that it was counter-productive to make allegations that could be disproved - and murder claims definitely fall into that category! However the publication of the Report of the Commission to Inquire into Child Abuse (Ryan Report) in May 2009 encouraged our more fanatical anti-clerics to try again. I have written about former Minster for Justice and Equality Alan Shatter in a previous article. In 2009 he was a Fine Gael backbencher and I think, their spokesman for Justice and Equality (!). 

In my article "The Maurice McCabe Affair - Six Top Level Resignations To Date (and More to Come?)",  I wrote concerning Shatter:
Alan Shatter: In 2009 Shatter demanded - and got - a high level Garda investigation into allegations that the Catholic Church had been involved in the unsolved murder of  a 10 year old girl Bernadette Connolly, four decades previously in 1970. A year later he was told by the then Minister for Justice Dermot Ahern (Fianna Fail) that no evidence of such collusion had been found. A few months after that, Fianna Fail were out of power and in March 2011, Shatter himself became Minister for Justice in the new Fine Gael government. There was not a word from him subsequently about Bernadette Connolly, so we can assume that he did not suspect that Fianna Fail had colluded with the Gardai investigators to protect the Church! However Shatter further aggravated an existing climate of public hysteria - and fell victim to it himself three years later.
I think that may well be the final time in this country that a "respectable" politician, journalist or leader of a "Victims'" organisation demands an official inquiry into claims that the Catholic Church murdered children! It is ironic that it was a Jewish member of Dail Eireann who made that demand.

The article is behind a paywall but Ferriter  stresses the huge challenges faced by the State in its early years - and the role of the Dept of Justice and its first Minister Kevin O'Higgins.

... In most of these tasks civil servants played a key stabilising role and also generated much power for themselves. As JJ McElligott assistant secretary of department of finance in 1923 saw it, one of the advantages of the inexperience of O'Higgins and his colleagues and the distraction of the Civil War was that it allowed civil servants to get on with State building without too much political interference.

It is no harm to remember this heritage in light of the turmoil witnessed this week. A viable democracy and effective Civil Service emerging in the most difficult of circumstances were two of the main achievements of that era. Another enduring legacy of that period was excessive centralisation, too much power in the hands of individual civil servants and contempt for those who sought to expose wrongdoing or ask troubling questions.

On the assassination of Kevin O'Higgins in 1927, Ferriter writes:

O'Higgins was one of the most intriguing characters of the Irish Revolution and the subsequent counter-revolution  of which he was in the vanguard. Shot dead by three IRA men acting independently on his way to Mass in 1927, he is often regarded as the uncompromising "hard man" of Cumann  na nGaedheal in  the 1920s. In many respects he was, but he was no unthinking militarist with a lust for blood, and even during the Civil War was anxious legal normality take the place of martial law.

HOWEVER

 "There are no real rules of war", O'Higgins insisted, in defending the execution of anti-Treaty Republicans: "The safety and preservation of the people is the highest law." The attempt to dehumanise his Civil War opponents was propagandist caricature and ignored the sincerity and depth of their feelings of betrayal; just as he, in turn, was caricatured as a man whose heart had turned to stone. It had done nothing of the sort. In his colleague Eoin MacNeill's memoir of these fervid years, finally published last year, MacNeill recalled how he witnessed the assassination of O'Higgins in 1927. As MacNeill cradled him, O'Higgins told him "I want you to say that I forgive my murderers".

This was all the more remarkable given that four years previously during the Civil War, O'Higgins had buried his father after Republicans killed him during an attack on his house......

Compare that to the behaviour of the current Minister for Justice who slandered former Sister of Mercy Nora Wall in the Dail in 2009 and who is now trying to blame his own civil servants for his political problems!

Resignation of Tanaiste (Deputy PM) Frances Fitzgerald 28 Nov 2017

Frances Fitzgerald succeeded Alan Shatter as Minister for Justice after the latter was forced to resign in May 2014  and held the post until June 2017 when she was appointed Tanaiste. She was then succeeded by Charlie Flanagan as Minister for Justice. Notably Shatter himself had been  forced to resign in a bogus "scandal" that was linked to the Sergeant  Maurice McCabe whistleblower affair. A report to the then Taoiseach (Prime Minister) by Sean Guerin  into allegations made by McCabe claimed that Shatter had "not heeded" McCabe's voice. HOWEVER in May 2016 the O'Higgins Report concluded that Shatter, as Minister for Justice, had taken a personal interest in McCabe's complaints and allegations, had dealt with them appropriately, promptly and reasonably and that there had been a failure by McCabe to respond to letters sent by Shatter and his officials to McCabe's solicitors. Typically, this vindication was of no obvious benefit to Shatter - who had also lost his Dail  seat in the February 2016 General Election. Nor did it seem to do McCabe any harm!

Alan Shatter's political career was effectively ended by a fake scandal that was based on  the allegations made by Sergeant Maurice McCabe. I strongly suspect the current Charleton Tribunal will vindicate Frances Fitzgerald conduct when she was Minister for Justice, just as Mr Justice Kevin O'Higgins vindicated Alan Shatter. But will it make any difference? Fitzgerald was forced to resign because she allegedly knew about "smears" being used by the Garda high command in 2015 when they were defending themselves against allegations made by Sergeant McCabe in the course of the investigation by Mr. Justice O'Higgins.  In two recently discovered emails, from 2015, when she was justice minister, Fitzgerald was warned about “aggressive tactics” being deployed against Sgt McCabe by the Garda leadership. But what did these "smears"and "aggressive tactics" consist of? Why nothing more than the perfectly normal tactics used by defense lawyers when they are faced with false allegations against their clients. In addition to clearing Alan Shatter, Mr Justice O'Higgins concluded that claims of corruption made by Sergeant McCabe against five of his superiors - up to and including Garda Commissioner Martin Callinan - were false. It appears that the "aggressive tactics" of Garda management were both justified and successful! So why then was Frances Fitzgerald forced to resign?

The problem is that politicians - on all sides - insist on treating Maurice McCabe as a sacred cow, a secular saint who can do no wrong. This has continued even after the publication of the O'Higgins Report. As reported in an article by Senan Molony, Taoiseach Leo Varadkar said in the Dail on 21st November:

"I want to say Sgt McCabe is somebody who I have had dealings with. I met him when I was minister for transport, tourism and sport when he made allegations relating to penalty points. He is one of the bravest people that I have ever encountered in public life and he is somebody who has been very much wronged by the State on a number of occasions because of his bravery and because of his willingness to shine a light into some dark places."

Frances Fitzgerald  had expressed similar unconditional support for the whistleblower. This placed her and the Government in a ludicrous dilemma where the Opposition expected them to prevent Sergeant McCabe's Garda colleagues and superiors from defending themselves against false accusations made by the whistleblower.  Any attempt to do so was seen by the Opposition as "aggressive tactics" and "smears"!

 [ As also reported by Senan Molony, Labour Party leader Brendan Howlin said:
The legal strategy was designed to fundamentally discredit Sgt Maurice McCabe and subvert the course of justice, a matter of enormous importance. This good man could have been destroyed.’ He added: ‘At the same time the Garda commissioner [then Noirin O'Sullivan] was instructing her lawyers to discredit Sgt McCabe, she and the Tánaiste [Frances Fitzgerald] were publicly lauding him. ‘The strategy was fundamentally dishonest.’]

Following the fall of Frances Fitzgerald and the political destruction of Alan Shatter, the current Minister for Justice Charlie Flanagan is now firmly in the firing line. It is useless to  expect him to do the decent thing and criticise Sergeant Maurice McCabe. Clearly he is going to throw his civil servants to the wolves in an attempt to save his own political skin!

Charlie Flanagan has publicly supported Sergeant Maurice McCabe as did Frances Fitzgerald when she was Minister for Justice, not to mention Taoiseach Leo Varadkar who supported Fitzgerald until the media and political pressure to dump her became impossible to withstand. Flanagan and Varadkar are the likely next targets of this witch-hunt and they have no intention of questioning the credibility of Sergeant McCabe. Accordingly they need to provide the witch-hunters with other scapegoats. Unfortunately the leader of Fianna Fail Michael Martin, is taking the view that Fine Gael's difficulty is FF's opportunity and piling on the pressure.

Jennifer Bray Deputy Political Editor of The Irish Daily Mail wrote on 30 November:
After a fortnight that saw one minister and a senior civil servant quit, another minister apologise to the Dail  and the Taoiseach forced to correct the House record twice, Mr Varadkar's position has weakened and Mr Martin is demanding major reforms in how this Government works - particularly within the harshly criticised  Justice Department. [My emphasis] ......

An independent group will be established to implement the recommendations of the Toland Report, which was published in 2014, and found there was a 'deferential relationship' towards the gardai in the department. The group will review the specific relationship between the department and the  gardai. ..
Mr. Varadkar has said that an external inquiry will investigate how key emails about the treatment of whistleblower Maurice McCabe were mot among the 230 documents sent to the Charleton Tribunal, which is inquiring into the treatment of the Garda sergeant. And after twice correcting the record of the Dail,the Taoiseach has said: 'I will be holding the department and its senior officials to account to ensure that neither I nor any minister nor any member of the Dail is ever put in that position again.' .....

The Taoiseach said that the 'change and implementation group' is to review the culture in the department and make recommendations, particularly in light of the evidence of a secretive culture, and a failure to provide accurate information to the Oireachtas. ...

Justice Minister Charlie Flanagan also this week apologised for his role in the saga. He said he was 'shocked and frankly, horrified' that there were records in the department that should have been provided to the tribunal. He said it has been ''a major challenge at every step to obtain complete information in a timely manner', adding: 'Indeed on a few occasions recently, information has been provided by me, to the Taoiseach, and then to this House, which has proved subsequently to be inaccurate. This is completely unacceptable and I wish to formally apologise to the Taoiseach, to you Ceann Comhairle, and to the House'.

TRANSLATION: Senior Civil Servants in Department of Justice are to blame for the fact that our Minister for Justice and our Prime Minister refuse to challenge the credibility of a 'whistleblower', several of whose allegations have already been found to be false by the Report of the O'Higgins Commission.of Investigation. 

Three Inquiries Now in Progress (December 2017)

There now appear to be three different inquiries in process centered on the Department of Justice and the Gardai all resulting from the allegations of Sergeant McCabe - he whose conduct must never be criticised!

• One is the Disclosures Tribunal chaired by Mr Justice Peter Charleton of the Supreme Court.to investigate alleged smears against Sergeant McCabe (by senior Gardai whom he wrongly accused of corruption!).  I think this is due to report around Easter 2018. 
• A review of the email 'scandal' ordered by the Taoiseach to ascertain why certain emails now deemed relevant for the Disclosures Tribunal were not discovered earlier by senior civil servants in Department of Justice. This review was originally supposed to be carried out by the Secretary General of Dept of the Taoiseach but - following the usual media outcry - it has been given to an "independent" barrister - senior counsel Michael Collins. The deadline for the completion of the review has according been moved from the end of 2017 to 19 January 2018.
• There is also a "root and branch" investigation into the functioning of the Justice Department which has been agreed between Leo Varadkar and Fianna Fail leader Michael Martin,following the recent controversies. According to the Irish Times on 28 November, Leo Varadkar said that:  An independent change and implementation group [My emphasis] will review the department’s culture particularly in light of “evidence of a continued siloed and secretive culture and a failure to provide accurate information to me and the Oireachtas”. The group would “appropriately structure” the relationship between the Garda and department to ensure accountability and better performance.

When Varadkar talks about a "continued siloed and secretive culture", this is a reference to the Toland Report on the Dept of Justice published in July 2014. Senior civil servants regard the Report as  superficial and misguided. Its publication led to the resignation of then Secretary General Brian Purcell and the extreme difficulty in getting a replacement for him. Noel Waters was supposed to take over as temporary caretaker for a few weeks until a new Secretary General could be appointed. However no credible candidate emerged over the next two years and Waters reluctantly accepted the poisoned chalice in October 2016. Now Waters has also resigned and the Toland Report is back on the agenda with a vengeance!
In an Irish Times article on 30 November  Colm Keena quoted the views of senior civil servants on Toland:
...... Richard Moore, who spent three years with the department as press officer for [Fianna Fail Justice Minister, 2008-11] Dermot Ahern, said he would describe the department as being “protective of rather than deferential to the Garda”. In his experience working in five different departments, the senior staff in the department “are among the best I came across”. His experience was of a high standard of competence and an ability to deal with the crises that are inherent in the work of the department. “There was no headless chicken stuff when I was there.”

Another senior political source said his experience was the direct opposite of what the Toland report said about the department’s relationship with An Garda Síochána. The Toland report was “superficial and unsubstantiated” with very little evidence produced for what was in essence “a series of assertions. In my experience there was no silo mentality,” according to this source. [My emphasis]

Colm Keena remarks that Toland also noted that “one of the key strengths” of the department was the “willingness, flexibility and can-do attitude of many of its loyal staff”. Unfortunately this is something that is unlikely to survive a politically motivated onslaught by our Taoiseach and Minister for Justice, both interested in diverting media attacks away from themselves and towards their civil servants.

FINALLY My Predictions for 2018

Of the three inquiries currently in progress, I think it is likely that:

• Mr Justice Peter Charleton (Disclosures Tribunal) will conclude that senior Gardai did not conduct a "smear campaign" against  Sergeant Maurice McCabe during the course of the O'Higgins Commission of Investigation, but simply defended themselves against the false allegations of corruption that he had made against them.
• Regarding the email inquiry, senior counsel Michael Collins will find that there was nothing untoward about the late location of certain emails for the Disclosures Tribunal. At most he will find that civil servants in Dept of Justice were overwhelmed by the volume of work generated by numerous Parliamentary Questions.
• The REAL disaster will occur  in relation to the "Change and Implementation Group" which is likely to demand that the recommendations of the Toland report be fully implemented in spite of the fact that they are impractical. This is likely to damage the ethos of the Department of Justice and make it difficult to attract and retain high-performing senior civil servants - including a credible new Secretary-General!

Obviously Justice Minister Charlie Flanagan does not have the moral stature to stand up for his civil servants in the face of ignorant or malicious criticism. He will agree to implement any "reforms" in order to save his own political skin!

The Sergeant and The Secretary-General: Can We Trust Our Civil Servants?

Introduction and Summary

Since 2014 the Garda Whistleblower Scandal - mainly centering on Sergeant Maurice McCabe - has resulted in the resignation of two Ministers/former Ministers of Justice (Alan Shatter in May 2014 and Frances Fitzgerald now on 28 November ), two Garda Commissioners (Martin Callinan in March 2014 and Noirin O'Sullivan in September 2017), two Secretary-Generals of the Department of Justice and Equality (Brian Purcell in July 2014 and now Noel Waters on 28 November). The reputation of Taoiseach (Prime Minister) Leo Varadkar has been weakened as has that of the current Minister for Justice Charlie Flanagan. Charlie Flanagan has been forced to apologise in the Irish Parliament to one of his chief critics Alan Kelly TD. and  retains his position largely because nobody wants an election before Christmas. (Also the opposition have already got their pound of flesh following the recent resignations of Frances Fitzgerald and Noel Waters!) 

The effect of the allegations made by Maurice McCabe has been extra-ordinary - not least because the report of the O'Higgins Commission published in May 2016 found that many of his dramatic allegations were false - a point I covered in my recent article "Sergeant Maurice McCabe and 'Corrupt' Garda Officers. For example

(i) The report cleared the former Garda Commissioner Martin Callinan of an allegation of corruption made by Sgt McCabe regarding the alleged placement of a senior officer on a promotion list. The allegation had no foundation
.
(ii) Complaints of corruption made by Sgt McCabe against Assistant Commissioner Derek Byrne, Chief Superintendent Colm Rooney and Superintendent Michael Clancy were all found to be hurtful and unfounded. Sergeant McCabe also made allegations against his immediate superior Inspector Noel Cunningham– later promoted to superintendent. These were also dismissed and categorised as “unjustified criticism".

(iii) Claims of corruption in investigations. The report found no evidence of garda criminality or corruption, but found junior gardaí were allowed investigate cases without sufficient supervision from more senior officers..............

MY QUERY:How is it possible for anyone to mistakenly accuse FIVE superior officers - and some colleagues - of corruption?

The Current Position:

In February 2017 the then Minister for Justice, Frances Fitzgerald set up a "Tribunal of Inquiry into Protected Disclosures", sole member Mr Justice Peter Charleton, Judge of the Supreme Court. This is to investigate whether former Garda Commissioners Callinan or O'Sullivan or other senior Gardai, contacted the media or otherwise tried to discredit whistleblowers who made disclosures of wrongdoing - mainly Sergeant Maurice McCabe but also Garda Keith Harrison. Also to investigate if senior Gardai attempted to use false allegations of sexual abuse to discredit Sergeant McCabe or Garda Harrison.

On 30 November Mr Justice Charleton published an Interim Report which dismissed the allegations made by Garda Keith Harrison in the  strongest terms. An article in TheJournal.ie is headed

On 2 December the Irish Independent carried a short article headed "The TDs Who Backed Keith Harrison" and named them as Labour TD Alan Kelly, left-wing Independents Clare Daly and Mick Wallace and Sinn Fein TD Pearse Doherty. All have also supported Sergeant Maurice McCabe. (For example see article in the Irish Times on 20 February 2017 Mick Wallace: To change An Garda, get rid of its hierarchy ).

The Current Problem - Desperate Politicians Targeting Civil Servants

Politicians, members of An Garda Siochana and senior civil servants are being targeted by an out-of-control media bent on whipping up hysteria and bringing down any prominent citizen. However the politicians are not just victims of hysteria. Several of those caught up in the current witch-hunt are left-wing and 'liberal' types who were very happy to use the media against their own perceived enemies. Now they find to their horror that they themselves have become prey for the monster they helped to feed! The reaction of Justice Minister Charlie Flanagan and Taoiseach Leo Varadkar is to blame their civil servants - who are forbidden by law to engage in politics and therefore have great difficulty in defending themselves. 

[The targets of these previous witch-hunts have been either Catholic clergy and religious or 'reactionary' journalists. However the influence of the Catholic Church in Ireland today is less than zero and the number of Irish journalists with viewpoints opposed to the 'liberal' consensus is also very small. One response  of 'liberals' is to turn on each other but for politicians, it is also tempting to blame their civil servants!]

Alan Shatter claimed in 2009 that the Catholic Church was implicated in the murder of a 10 year old girl in 1970. He demanded - and got - a high level Garda inquiry lasting a year,  into his false allegation. 

Charlie Flanagan slandered Nora Wall in the Dail (Irish Parliament) also in 2009 - repeating an allegation in respect of which she had received libel damages from the Sunday World in 2002. 

Leo Varadkar and Frances Fitzgerald supported the witch-hunt against journalist Kevin Myers a few months ago - and approved of the fact that he had been fired by the Sunday Times. 

Alan Shatter's political career has since  been terminated - and that of the others adversely affected - by the type of media hysteria that they themselves had endorsed when it suited them to do so. Now the politician-survivors want to present the media mob with other targets!

Resignation of Secretary General Noel Waters on 28 November

When the previous Secretary General of Dept of Justice Brian Purcell stepped aside in July 2014, following criticism of his Department in the 'Toland Report', he hinted that he did not agree with the findings of that Report. His reluctant successor Noel Waters went  a lot further when he told Minster Charlie Flanagan of his decision to resign. An article in the Irish Independent by Shane Phelan on 29 November is headed Departing Justice Boss Makes an Unprecedented Attack on Taoiseach

It is indeed unprecedented for a senior civil servant to make an attack on politicians but this is this is what Noel Waters has done in defense of his own staff in the Department of Justice. 

The departing secretary general of the Department of Justice fired a parting shot at TDs and the media as he retired yesterday with immediate effect. Noel Waters defiant email to colleagues notably came within hours of Taoiseach Leo Varadkar making a speech in which he described the department as "dysfunctional". Mr Waters ...claimed that much of the criticism voiced in the Dail and the press had been "unwarranted" and that he expected the department to be vindicated by an external inquiry......His decision came after much criticism of the department's failure to disclose emails to the Charleton Tribunal when it sought information earlier this year.

Mr Varadkar announce he was ordering an external inquiry into why important emails "were not found and therefore not sent on" to the tribunal. This inquiry will report before Christmas. If the emails were deliberately withheld from the tribunal, something the department denies, it would amount to a criminal offence. The emails revealed Ms Fitzgerald had been told of the "aggressive stance" then Garda Commissioner Noirin O'Sullivan's legal team was taking against Sergeant Maurice McCabe at the O'Higgins Commission.

Mr. Varadkar also said the Government was accelerating reforms already in train, and was planning "radical action to restore public confidence in the Department of Justice".

But in his letter to colleagues, Mr Waters claimed the department had been to "a barrage of unwarranted criticism in recent days and most particularly today. I want to assure you that in so far as is humanly possible, this department has sought at all times to act appropriately, upholding the law and the institutions of the State" he said. "Many of the claims about how the Department has acted that have been made in the media and the Dail are not true, and I am confident that the processes that the Taoiseach has announced will show that to be the case".

While the above headline highlights the role of Taoiseach Leo Varadkar, the  article on top of the same page  is headed  'I Missed Significance of Email at Centre of Row,' Admits Flanagan and features our current Justice Minister disclaiming personal responsibility and blaming his own officials. I suspect that  is the more likely cause of Noel Waters resignation!

Justice Minister Charlie Flanagan admitted that he "missed the significance" of the email at the centre of the controversy that brought the Government to the The under-fire minister told the Dail last night [28 November] that he was "shocked and frankly horrified" that documents in the possession of the Department of Justice had not been handed over to the Charleton tribunal. He poured blame on officials in his department saying it was "a major challenge at every step to obtain complete information in a timely manner, indeed on a few occasions recently, information has been provided to me, to the Taoiseach, and then to this House, which has proven subsequently to be inaccurate. ". .....

Fianna Fail leader Michael Martin told the Dail the current row "must be the nail in the coffin of the secrecy and silos in the Department of Justice. Yes there must be a fundamental change in the culture of that Department, but Government must also take responsibility and take legitimate questioning by the Opposition, not as partisan grandstanding all the time.. Over the past three weeks the Government has taken too dismissive an attitude to Opposition members who raised very important and profound questions," he said.

As part of the reforms being planned for Justice, TDs are to be given an opportunity to sit down face to face with the senior officials to ask questions........

MY COMMENT: 
There is a discussion on the politics.ie website regarding the topic  "Charlie Flanagan Next" and at one point I tried to summarise as follows:
The basic issue is fairly straightforward. Sergeant Maurice McCabe claimed that FIVE of his superiors were corrupt - all the way from the Inspector who was his immediate boss right up to Garda Commissioner Martin Callinan. These claims were found by the O'Higgins Commission to be false and it was inevitable that the Gardai were going to contest them. But at the same time politicians, like the then Justice Minister Frances Fitzgerald, felt obliged to treat Sergeant McCabe as a paragon of virtue and truth. There was an obvious contradiction there. The way to avoid this in future is for claims by Whiste-blowers to be treated in the same way as any other allegations of wrong-doing. This means they are NOT to be automatically accepted OR rejected from the word go!

The politicians - including Taoiseach (Prime Minister) Leo Varadkar and current Justice Minister Charlie Flanagan - have tried to iron out the contradiction and evade responsibility by accusing their civil servants of failing to supply them with accurate information. One result of their behaviour is that it will be very difficult to find anyone of suitable caliber to replace Noel Waters as Secretary General of the Department of Justice. His predecessor Brian Purcell was obliged to step aside in similar dubious circumstances in 2014. Noel Waters was originally supposed to fill the position on  a temporary basis for a few weeks until a new Secretary General was appointed but  no suitable candidate emerged to accept the poisoned chalice. So who on earth is going to accept it now?
